Welcome to My Petsworth! The terms "we", "us" and "our" refer to My Petsworth, a trading name of TradeTrends (Chamber of Commerce no. 94912882). My Petsworth operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). My Petsworth is powered by Shopify, which enables us to provide the Services to you.

Please read these Terms of Service carefully, as they include important information about your legal rights. By visiting or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.

Section 1 – Access and Account By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or territory. You are solely responsible for maintaining the security of your account credentials and for all activity on your account.

Section 2 – Our Products We have made every effort to accurately represent our products. However, colours or appearance may differ slightly due to your device settings. Product dimensions and sizes are listed on each product page; please check them before ordering. All product descriptions are subject to change at our sole discretion.

Section 3 – Orders When you place an order, you are making an offer to purchase. My Petsworth reserves the right to accept or decline any order at its discretion. Your order is not accepted until we confirm acceptance and process your payment. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after acceptance. If we cancel an order after payment, we will refund you in full. Purchases are subject to our Refund Policy.

Section 4 – Prices and Billing All prices are in Australian dollars (AUD) and include GST where applicable. Prices are subject to change without notice. The price charged will be the price in effect at the time of your order, as confirmed in your order confirmation email. You agree to provide accurate and complete payment information for all purchases.

Section 5 – Shipping and Delivery All delivery times are estimates only and are not guaranteed. Delivery may take longer during busy periods or because of carrier delays. Risk of loss passes to you once your order has been delivered.

Section 6 – Intellectual Property All content on the Services, including trademarks, text, images, graphics, and design, is owned by My Petsworth or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

Section 7 – Optional Tools We may provide access to third-party tools on an "as is" basis without any warranties. We are not liable for your use of any optional third-party tools available through the Services.

Section 8 – Third-Party Links The Services may contain links to third-party websites. We are not responsible for the content, privacy practices, or accuracy of any third-party sites. Accessing third-party websites is at your own risk.

Section 9 – Relationship with Shopify My Petsworth is powered by Shopify. Any sales and purchases made in our store are made directly with My Petsworth. Shopify is not responsible for any aspect of transactions between you and My Petsworth.

Section 10 – Privacy Policy All personal information collected through the Services is subject to our Privacy Policy. By using the Services, you confirm that you have read and understood our Privacy Policy.

Section 11 – Feedback By submitting feedback, reviews, or suggestions, you grant My Petsworth a perpetual, royalty-free licence to use, reproduce, and publish such content in connection with My Petsworth. Reviews must be honest and based on your own experience. You represent that you own or have the right to submit any feedback provided.

Section 12 – Errors and Omissions We reserve the right to correct any errors, inaccuracies, or omissions at any time, including after an order has been submitted. If a correction changes the price of your order, we will contact you first and you may cancel for a full refund.

Section 13 – Prohibited Uses You may only use the Services for lawful purposes. You may not use the Services to engage in unlawful activity, infringe intellectual property rights, transmit harmful or misleading content, or interfere with the security of the Services.

Section 14 – Termination We may terminate your access to the Services at any time without notice. All provisions that by their nature should survive termination will continue to apply.

Section 15 – Disclaimer of Warranties To the extent permitted by law, the Services are provided "as is" and "as available". We do not guarantee that the Services will be uninterrupted, timely, or error-free. This section does not affect the guarantees that come with our products under the Australian Consumer Law.

Section 16 – Limitation of Liability To the extent permitted by law, My Petsworth shall not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the Services. Where the law allows us to limit our liability for a failure to meet a consumer guarantee, our liability is limited to replacing the goods or refunding the price paid.

Section 20 – Governing Law These Terms are governed by the laws of the Netherlands. This does not take away the protection of any mandatory consumer law of the country where you live, including the Australian Consumer Law.

Section 21 – Changes to Terms We reserve the right to update these Terms at any time. Changes will be posted on this page and are effective upon posting. The version in place at the time of your order applies to that order.
